Summary of Requirements

Engage an Implementing Partner (IP) to conduct detailed needs assessment on the state of play in Ukraine related to tracings, seizing, confiscating, managing and re-using criminal assets. In particular, the research shall include an overview of the national legal framework; structure of the agencies involved in asset recovery and management; main gaps and needs of national institutions in applying asset recovery provisions and tools in the fight against TOC and corruption.

 

  • Conduct a mapping of all national institutions, agencies and other stakeholder involved in the entire asset recovery process (financial investigations, asset seizure, asset confiscation, asset management and re-use) and describe what their role, responsibility and function is the recovery of criminal assets. 
  • Outline the currently legislative framework and its key aspects regulating the asset recovery processes and procedures. This should include the existing strategies and action plans that tackle asset recovery.
  • Interact with identified stakeholders to conduct a detailed assessment of current main challenges and needs in locating, tracing, and recovering criminal assets located both in the country and abroad.
  • Provide an overview of the key gaps in the management of frozen, seized and confiscated criminal assets.
  • Map existing technical assistance provides in Ukraine that focus on asset recovery and provide an overview of the specific aspects of the comprehensive asset recovery process that they cover.
  • Based on assessed needs and gaps, formulate recommendations for future capacity-building assistance on countering the threats of organized crime and corruption by means of asset recovery in Ukraine.
